1 - THE PROMOTER AND HOW TO ENTER

1.1 The promoter is PFG Kilternan taverns LTD, Enniskerry road, Dublin 18

1.2 Each competition will run during the given Promotional Period, details of which can be found on each specific competition terms and conditions. The promoter reserves the right to extend all competitions for up to 30 days following the initial Promotional Period. 

1.3 All competition entries must be received by the Promoter either through your online account or at the address set out at condition 1.1 during the Promotional Period. All competition entries received after the Promotional Period are automatically disqualified.

1.4 To enter the competition: 

1.4.1 visit www.Irishluxuarycompetitions.ie and log into your account (or create one for free), then purchase your ticket (s) (Maximum of 20 entries per person via any route) during the Promotional Period to be entered into the prize draw; or 

1.4.2 via the No-Purchase Necessary route, visit www.mckinneycompetitions.com and log into your account (or create one for free) then send a non enclosed postcard to: Irish Luxuary competitions, Enniskerry road, Dublin 18, with the name of the competition you are entering, your name, email address (of which used in registering account), phone number and answer to question during the Promotional Period to be entered into the prize draw. Registered accounts must be fully completed or entry will not be processed. Please see condition 1.5 for additional terms that apply to the No-Purchase Necessary route. 

1.5 No Purchase Necessary terms. No purchase necessary and there is no charge to register for use of the website. Only one entry per postcard is permitted. Postal Entries will be checked and processed every Monday. All valid No Purchase Necessary entries will be given the same chance of winning as all other entries and these Terms and Conditions shall apply equally to entries via the No Purchase Necessary route. All participants using this entry route should take note of the timings of this competition and factor in time for their entry to reach the address set out above and allow at least 3 working days for their entry to be processed. All No Purchase Necessary entries must be received by the Promoter at least 48 hours prior to the end of the Promotional Period. Any free entries received after this time will not be processed and correct entries will not be entered into the draw. If No Purchase Necessary entries are received after the maximum number of entries for the competition has been reached, they will not be processed and correct entries will not be entered into the draw. Upon receipt of valid entries via this no-purchase necessary route, the Promoter will send entrants an email with their ticket number. There is a limit of one entries to the competition per person via the No Purchase Necessary Route.

1.6 The maximum number entries to the competition will be stated on the website. The number of entries any individual can make may be limited if the maximum number of entries is reached.

1.7 Entries on behalf of another person will not be accepted and joint submissions are not allowed. 

1.8 The Promoter will not accept: 

1.8.1 responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or 

1.8.2 proof of posting or transmission as proof of receipt of entry to the competition.

2 - ELIGIBILITY

2.1 The competition is open to all residents in the UK and Republic of Ireland, aged 18 years or over, except, 

2.1.1 employees of the Promoter or its holding or subsidiary companies; 

2.1.2 employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or 

2.1.3 members of the immediate families or households of 2.1.1 and 2.1.2 above.

2.2 By entering the competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the competition. 

2.3 The Promoter will not accept competition entries that are automatically generated by computer, completed by third parties, consumer groups or in bulk, or incomplete, illegible, have been altered, reconstructed, forged or tampered with. 

2.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition. 

2.5 Competition entries cannot be returned and refunds cannot be granted in respect of purchased tickets.

3 - THE PRIZE

3.1 The Prize available to be won will be detailed in each of the individual competitions. Please see the specific competition terms and conditions for further details. 

3.2 The winner will be required to prove they are a resident of the United Kingdom or Republic of Ireland and may be required to provide identification, and if the prize is a car, a valid driving licence, prior to collection or delivery of the Prize. 

3.3 The Prize may either be delivered to the winner’s address or the winner may collect the Prize in person. 

3.4 If the Prize is a car, the Prize does not include insurance, the cost of fuelling the car, tax or any other expenses. If the Prize is a car, the Promoter will supply the car with a 3-month vehicle warranty from the date the Prize is provided and a MOT test valid for 12 months. The warranty will cover engine and gearbox only. Wear and tear items will not be covered under a warranty at any time. You will be responsible for ensuring the valid tax and insurance is obtained prior to driving the car. Any other costs incurred and that are incidental to the fulfilment of the prize are the responsibility of the winner(s). 

3.5 If the Prize is a holiday you will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents and insurance for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed. 

3.6 Prizes are not negotiable or transferable and are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value. 

3.7 In the event that the Promoter is unable to proceed with a competition due to lack of entrants, a winner will be drawn at random and receive 50% of the net profits made from the competition, minus taxes, prize value, charity donation and marketing expenses. 

3.8 The Promoter may refuse to award the Prize, or seek its recovery, in the event of an entrant’s fraud, dishonesty or non-entitlement under these Terms and Conditions. 

3.9 If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries. 

3.10 If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations. 

3.11 To the extent permitted by law, the Promoter and its associated agencies, suppliers and distributors, will not in any circumstances be responsible or liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or damage, personal injury or death occurring as a result of taking up or accepting the prize accepting or using a Prize, except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

4 - WINNERS

4.1 One winner will be randomly selected from all valid entries received during the Promotional Period.

4.2 The winner will be contacted using the email address provided on entry within 5 working days of Winner Selection and will be required to respond to confirm eligibility and acceptance of the Prize, within 14 days of initial contact. In the event that a winner does not respond to the initial contact within 14 days, the Promoter reserves the right to disqualify that winner. If a winner is disqualified, the Promoter reserves the right to award that Prize as a bonus in a different promotion. The Promoter does not accept any responsibility if you are not able to take up the prize. 

4.3 The winner will be contacted within 28 days of acceptance of the Prize to organise delivery of their Prize. The Prize may not be claimed by a third party on your behalf. 

4.4 The decision of the Promoter is final, and no correspondence or discussion will be entered into. 

4.5 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of prize winner and, if applicable, their winning entry within one month after the Closing Date of the competition. In addition, all winners will be expected to take part in marketing activity including prize giving and charity donation. Each promotional session will include photography, video and on occasion localised press may be present. 

4.6 If you object to any or all of your surname, county and winning entry being published or made available, or object to taking part in marketing activity, please contact the Promoter by sending an email to info@mckinneycompetitions.com with “Competition Name Request” in the subject line. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. 

4.7 The Promoter will only process your personal information as set out in the Privacy Policy. See also condition 4.5 and condition 4.6, with regard to the announcement of winners. 

5 - GENERAL

5.1 If any provisions of these Terms and Conditions are judged to be invalid, illegal or unenforceable, this shall not affect or impact the continuation in full force and effect the remainder of the provisions. 

5.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition. The Promoter reserves the right to hold, void, suspend, cancel, or amend the competition where it becomes necessary to do so.

5.3 These terms and conditions shall be governed by Northern Irish law, and the parties submit to the non-exclusive jurisdiction of the courts of Northern Ireland.
